All deposits are due at the time of booking in order to secure the date. All deposits are non-refundable. Balance must be in full at time of session. Client is responsible for any airfare, hotel, stay, transportation and incidentals if session is held outside of the photographer’s home area (Harvey/Minot). Session will begin promptly at the scheduled time. You should be ready to go when you arrive. Photographer will wait for 15 minutes past your start time; if you do not show session is deemed cancelled and deposit is forfeited.

Post processing is usually a couple of days but may be as long as two weeks. Special events may require longer. As soon as your images are complete you will receive a link to the gallery via email.  

Session may be subject to rescheduling due to weather. Photographer will make wise judgement and will take your best interest in mind when determining weather. Automatic weather reschedules may include rain, dark dreary skies, wind speeds of more than 15 mph and temperatures below 30 degrees. In the unlikely event the photographer is injured, becomes ill or has an extreme emergency that prevents the photographer from photographing the event the photographer will make every attempt to reschedule or find a replacement. Photographer uses their own discretion to find a replacement photographer that they feel is suitable to fit the standards of Memories by M Photography.

Reschedule policy: If YOU must reschedule your session for any reason other than weather your session must be rescheduled and held within 90 days of the original session date. If you must reschedule your session more than once for reasons other than weather you will be charged a $50 rescheduling fee.  

In the extreme case that photos are lost due to corruption or equipment failure Memories by M Photography is not held responsible for lost phots. Session may be rescheduled. 

 

Photographer prefers clean and natural images showing the persons true self, therefore she does not retouch extensively. A blemish will be touched up. Please be aware that photographer will not remove birthmarks or scars.

Each session comes with a various number of images, no less than 20 unless a mini session. Number of images is greatly dependent on the type, length, and cooperation of children. Images are delivered to client electronically via downloadable file to your computer or mobile device. Images may be used for personal use and sharing. When sharing on social media you must give proper credit to Memories by M Photography.  

Images received from Memories by M Photography MAY NOT BE ALTERED OR EDITED IN ANY WAY from their original version. This includes but is not limited to: turning a color image black and white, adding text, cropping, color accents or filters. All images shot by Memories by M Photography are the property of the photographer. Please be aware that images may be used for advertising, promotion or sales. Client gives consent to photographer to use all images taken of the subject at discretion of the photographer.

You will receive a “LIMITED PRINT RELEASE” with your images. This release allows for the possessor to print images at a location of their choice for personal use only. Printing is strongly encouraged to be done at Mpix.com and strongly discourages from Shutterfly, Walmart, CVS, and any other printing kiosk. If you chose to print from these you are doing so against the advice of the photographer and the photographer is NOT responsible for any color distortion or image quality. Images may NOT be entered into any contest without the sole WRITTEN permission of the photographer. Client agrees to read and adhere to the rules states in the Limited Print Release. Any violations of the Copyright Protection Laws are punishable by law and Memories by M Photography does enforce any violation.

In hiring photographer you are choosing her for her creative and personal style. Please do not expect photographer to shoot in any other way than that of which you have seen unless photographer states otherwise.

Unedited images will not be given to the client or a third party under any circumstances.  

Photographer will chose the location for each session based on proper lighting conditions, session style and time of year. Locations will reflect the photographer’s style. If you have a specific location if will need to be checked prior to the session for lighting etc.

Client agrees to be cheerful, cooperative and communitive. If subject is moody or unresponsive photographer cannot be expected to get the best images. Please plan for children and bring snack, water, toys etc.

Limitations: Memories by M Photography shall not be liable for photographic opportunities lost or photographs deemed to be of less than superior quality due to weather, man-made hazards, eyesores, and lack of cooperation or interference by guests; vendors or other persons at the session, limitations placed on the photographer to make full use of proper equipment.

Client agrees to all locations being at their own risk and fully understands that at any time when working outdoors there are risks involved with terrain and elements. Photographer is NOT responsible for injuries that may occur while shooting at a location.   

 

All session sneak peaks are posted on facebook unless client gives written notification PRIOR to the session.

Client has 10 days from the date of the release of the session to the client to voice any concerns with images. After 10 it will be agreed that the client is satisfied with the session and images. Once a gallery has been downloaded it is assumed that client is satisfied.

While Memories by M Photography strives for 100% customer satisfaction photographer makes no guarantees to image quality of a specific shot or pose. Each session is unique by location, setting, lighting and situation.

We reserve the right to refuse service to anyone for any reason. If for any reason at any time photographer finds reason to terminate the contract you will receive a refund of your deposit.
